General terms and conditions

1. Scope and application

The General Terms and Conditions (hereinafter “GTC”) of Expertiva AG apply to all services offered by Expertiva AG. Customers are individuals & legal entities who enter into business relations and legal transactions with Expertiva AG. All activities are exclusively subject to the General Terms and Conditions of Expertiva AG. Any terms and conditions of the customer that conflict with or deviate from these GTCs will not be recognised unless Expertiva AG has expressly agreed to them in written form. Changes or amendments to the GTC by the customer are not permitted. The GTC may be amended by Expertiva AG at any time. A current and valid version of the GTC is published on the Internet site www.expertiva.ch and can also be requested. The GTC applicable to the customer are those valid at the time of registration or order placement.

2. Offer, customer base and conclusion of contract

All offers of Expertiva AG are non-binding. The offer is directed at individuals & legal entities in Switzerland and abroad. The contract shall be concluded at the time the written order is placed, unless Expertiva AG expressly withdraws from the order.

3. Prices

The prices of the services of Expertiva AG are in Swiss francs (CHF) excluding value added tax. Ancillary costs such as shipping costs or expenses are not included in the prices and can be charged separately. The valid and non-exhaustive price list can be viewed on the Internet site www.expertiva.ch.
Price changes and errors in the price labels are expressly reserved.

4. Terms of payment & means of payment

Expertiva AG reserves the right to serve customers exclusively against payment in advance.
Prepayments that are not settled within 5 days may be cancelled by Expertiva AG without giving reasons. Expertiva AG reserves the right not to reserve or provide the service until payment has been received, and any entitlement to any discounts and commissions shall also lapse.
Additional fees may be charged for all payment methods except prepayment. The amount of the fee depends on the payment method. In addition, fees for invoicing, late payment, interest & reminders may be charged to the customer.
Means of payment
a) Advance payment
b) Invoice: Payment of the entire invoice amount within 10 days of the invoice date. One-time processing fee CHF 10.00
c) Card payment (e.g. credit card or Maestro card): Plus 3% commission on the order value (net)

5. Late payment & reminder fees

If the customer does not make payments by the respective due date (expiration date), he shall be in default without further reminder. A fee of CHF 40.00 per reminder will be charged on the respective outstanding amount and must be paid by the customer in any case.
All other expenses and outlays in connection with the collection of outstanding amounts shall be borne by the customer.
Expertiva AG has the right to withdraw from instalment payments and to demand immediate repayment of the entire remaining outstanding debt if instalment payments are outstanding.

6.Cancellation of an order

After placing the order, the customer may withdraw from the order within 24 hours by telephone or in writing, unless otherwise agreed. After this time, the order is considered binding and the order is definitively placed. If the customer is advised personally on site, the order is considered binding and placed as soon as the order is signed by the customer, unless the order has already been placed electronically using the registration form on the website www.expertiva.ch or by e-mail.
If the customer nevertheless wishes to cancel the order after the expiry of this period, but the order has not yet been commenced by Expertiva AG, a flat fee of CHF 180 plus VAT will be charged to the customer.
If the customer wishes to cancel an order that has already been commenced by Expertiva AG, the customer will be charged for the work performed up to that point in accordance with the price list.
Once an order has been completed, the customer shall owe Expertiva AG the entire order value.

7. Liability and exclusion of liability

a) Expertiva AG cannot guarantee the correctness, accuracy, up-to-dateness, reliability and completeness of the information on expertiva.ch.
Liability claims against Expertiva AG for material or immaterial damages arising from access to or use or non-use of the published information, misuse of the connection or technical faults are excluded.
All offers are non-binding. Expertiva AG expressly reserves the right to change, supplement or delete parts of the pages on the Internet or the entire offer without prior notice or to cease publication temporarily or permanently. Liability for indirect damage and consequential damage resulting from use, incorrect performance or loss of performance is excluded.
b) References and links to third party websites lie outside our area of responsibility. We decline any responsibility for such websites. Access and use of such websites is at the user’s own risk.
c) The copyright and all other rights to content, images, photos or other files on the website belong exclusively or to the specifically named holders of rights. For the reproduction of any elements, the written consent of the copyright holders must be obtained in advance.

8. Documents & invoice dispatch

All parties agree to the electronic sending of documents and invoices. If the customer explicitly requests a paper invoice or physical document dispatch by post, an additional fee of CHF 10.00 will be charged. Additional processing costs for secretarial work and shipping costs according to our price list may apply.

9. Dispatch of documents

The dispatch of customer documents or of documents of any kind on behalf of the customer by post will be charged per consignment at the currently valid flat rate for shipping and handling according to the price list. Additional processing costs for secretarial work according to our price list may be incurred.

10. Appointment cancellations & no-shows

Appointment cancellations can be accepted free of charge up to 24 hours before the planned appointment, by telephone, electronically or in writing. If an appointment is not taken or is cancelled within 24 hours before the planned appointment, the appointment will be charged to the customer with a flat fee of CHF 180 plus VAT.

12. Place of jurisdiction and applicable law

Swiss law applies.
The place of jurisdiction is Zurich ZH.
