General terms and conditions

1. Scope of application

The General Terms and Conditions ( hereafter "GTC") of Expertiva AG apply to all services offered by Expertiva AG. Customers are individuals and legal entities that enter into business relationships and legal transactions with Expertiva AG. All activities are exclusively subject to the GTC of Expertiva AG. Any terms and conditions of the customer that are contrary to or deviate from these GTC shall not be accepted, unless Expertiva AG has expressly agreed to them in writing. Changes or amendments to the GTC by the customer are not permitted. The GTC may be amended by Expertiva AG at any time. A current and valid version of the GTC is published on the website www.expertiva.ch and can be requested additionally. The GTC valid at the time of registration or order placement shall be binding for the customer.

2. Offer, clientele and conclusion of contract

All offers of Expertiva AG are non-binding. The offer is directed to natural & legal persons in Switzerland and abroad. The conclusion of the contract takes place at the time of the written placement of the order, unless Expertiva AG explicitly withdraws from the order.

3. Fees

The fees for the services of Expertiva AG are quoted in Swiss Francs (CHF) excluding value added tax. Additional costs such as shipping costs or third party fees are not included in the prices and may be charged separately. The valid and non-exhaustive price list can be found on the website www.expertiva.ch.
Prices are subject to change and errors in pricing are expressly reserved.

4. Terms & means of payment

Expertiva AG reserves the right to serve customers exclusively upon prepayment.
Payments made in advance, which are not settled within 5 days, can be cancelled by Expertiva AG without giving reasons. Expertiva AG reserves the right not to reserve or provide the service until payment has been received, as well as forfeiting any claim to possible discounts and commissions.
For all payment methods, except prepayment, additional fees may be charged. The amount of the fee depends on the payment method. In addition, fees for invoicing, late payment, interest & reminder can be charged to the customer.
Means of payment
a) Cash in advance.
b) Invoice: Payment of the entire invoice amount within 10 days of the invoice date. One-time processing fee CHF 10.00.
c) Card payment (e.g. credit card or Maestro card): Plus 3% commission on the order value (net).

5. Late payment & reminder fees

If the customer does not make payments by the respective due date (expiry date), he is in default without further reminder. Per reminder a fee of CHF 40.00.- will be charged on the respective outstanding amount and has to be paid by the customer in any case. All further expenses and disbursements in conjunction with the collection of outstanding amounts shall be at the expense of the Customer. Expertiva AG has the right to revoke installment payments and to claim immediate settlement of the entire outstanding balance if installment payments are outstanding.

6. Order cancellation

After placing an order, the customer may cancel the order within 24 hours by telephone or in writing, unless otherwise agreed. After that, the order is considered binding and the order is definitely placed. If the customer is advised personally on site, the order is considered binding and placed as soon as the order has been signed by the customer, unless the order has already been placed electronically using the registration form on the website www.expertiva.ch or by email.
If the customer nevertheless wishes to cancel after this time limit, but the order has not yet been started by Expertiva AG, a flat fee of CHF 180 plus VAT will be charged to the customer.
If the customer wishes to cancel an order that has already been started by Expertiva AG, the work performed up to that point will be charged to the customer according to the price list.
After an order has been completed, the customer owes Expertiva AG the entire order value.

7. Liability and disclaimer

a) Expertiva AG does not take any responsibility for the correctness, accuracy, timeliness, reliability and completeness of the information on expertiva.ch.
Liability claims regarding damage caused by the use of any information provided, including any kind of information which is incomplete or incorrect, will therefore be rejected.
All offers are non-binding. Expertiva AG expressly reserves the right to change, supplement or delete parts of the pages on the Internet or the entire offering without prior notice, or to cease publication temporarily or permanently. Liability for indirect or consequential damages resulting from the use, misuse or loss of performance is excluded.
b) References and links to third party websites are out of our area of responsibility. Any responsibility for such websites is declined. The access and use of such websites is at the user's own risk.
c) The copyright and all other rights to the content, images, photos or other files on the website belong exclusively or the specifically mentioned legal owners. For the reproduction of any elements, the written consent of the copyright holders must be obtained in advance.

8. Documents & invoicing

All parties agree to electronic document and invoice delivery. If the customer explicitly requests a paper invoice or physical document delivery by post, an additional fee of CHF 10.00 will be charged. Additional processing costs for secretarial work and shipping costs may be applied according to our price list.

9. Shipping of documents

The shipment of customer documents or documents of any kind on behalf of the customer by post will be charged per delivery at the currently valid flat rate for shipping according to our price list. Additional processing costs for secretarial work may be charged according to our price list.


10. Appointment cancellations & no-shows

Appointment cancellations can be accepted free of charge up to 24 hours before the scheduled appointment, by telephone or in writing. If an appointment is not kept or cancelled within 24 hours of the scheduled appointment, the appointment will be charged to the client with a flat fee of CHF 180 plus VAT.

12. Jurisdication and applicable law

Swiss law is applicable.
The place of jurisdiction is Zurich ZH.
